Problems on the Informed Consent Duty


Abstract
The Civil Code article 683 (Mandatory Duty to Report) A mandatory shall upon demand of the mandatory report on the condition of the management of the affairs entrust-ed to him, and upon the termination of the mandate he shall make a full report thereon without delay.
According to the Act, if a doctor examines a patient, he is obliged to explain the result to him. It is right that a doctor should give a patient medical treatment after receiving the requirement of it from him or his family. After the treatment the doctor should promptly give a full account of it to them.
As the result of it, the burden of the duty to explain may often place the active treatment under restriction and there is a problem to bring even the possibility of present-ing a phenomenon of contracting medical care.
Therefore special regard must be paid to the assertion that the doctor¢¥s duty to explain should be performed with his fair medical judgment and discretion.
